1. Agreement
By using the services provided by Webfire Internet Services ("Webfire," "we," "us"), you agree to these Terms of Service. If you do not agree, please do not use our services.
2. Services
Webfire provides shared web hosting, virtual private server (VPS) hosting, and related infrastructure services. Service descriptions, features, and pricing are available on our website and may be updated from time to time.
3. Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Keeping your contact and billing information current
- Ensuring your use of our services complies with applicable laws
4. Acceptable Use
You may not use Webfire services to:
- Host or distribute illegal content
- Send unsolicited bulk email (spam)
- Distribute malware or engage in phishing
- Attack or attempt to compromise other systems or networks
- Consume resources in a way that degrades service for other customers
We reserve the right to suspend or terminate accounts that violate these terms.
5. Billing and Payment
Services are billed on a monthly basis at the rates listed on our website. All prices are in Canadian dollars (CAD). We do not increase prices at renewal — the price you sign up at is the price you continue to pay unless we notify you of a rate change at least 30 days in advance.
6. 30-Day Money-Back Guarantee
Webfire offers a 30-day money-back guarantee on shared hosting and standard virtual private server (VPS) plans, subject to the conditions and limitations set forth in this section. This guarantee is intended solely to allow eligible new customers to evaluate Webfire's services with reduced financial risk and shall not be construed as an unconditional right to a refund.
6.1 Eligibility
The 30-day money-back guarantee is available only to new customers who have no prior service history with Webfire, including under any related account, organization, or payment method. To be eligible, the following conditions must be satisfied:
- The refund request must be submitted in writing within thirty (30) calendar days of the initial activation date of the service (not the invoice date, if different).
- The account must be in good standing at the time of the request, with no outstanding balance, no pending disputes, and no history of abuse, policy violations, or abnormal usage patterns.
- Only one (1) refund may be issued per customer, organization, household, or payment method, regardless of the number of accounts or services ordered.
6.2 Scope of Refund
The guarantee applies exclusively to the base hosting service fee for the initial billing period. All other charges are non-refundable under any circumstances, including but not limited to:
- Domain registrations, domain renewals, and domain transfers
- Setup fees, migration services, onboarding assistance, and administrative labour
- Third-party software licences, including but not limited to control panel licences, operating system licences, and security software
- Add-on services, upgrades, resource overages, bandwidth charges, and any usage-based billing
- Dedicated servers, GPU hosting, colocation, custom infrastructure, and any bespoke or individually quoted services
- SSL certificates and any other ancillary products or services
6.3 Exclusions and Disqualifications
The 30-day money-back guarantee does not apply, and no refund shall be issued, in the following circumstances:
- The account has been suspended, terminated, or flagged for any violation of these Terms of Service, the Acceptable Use Policy, or any other Webfire policy.
- The account has been used for excessive resource consumption, including but not limited to high CPU utilization, disk I/O, memory usage, or bandwidth consumption inconsistent with typical onboarding, evaluation, or testing activity.
- The service has been used for production workloads, commercial operations, or any purpose beyond reasonable evaluation prior to the cancellation request.
- The customer has previously received a refund from Webfire under this or any prior guarantee policy.
- Webfire determines, in its sole and absolute discretion, that the refund request is made in bad faith, as part of a pattern of abuse, or in an attempt to obtain services without payment.
6.4 Discretionary Authority
Webfire reserves the sole and absolute right to determine what constitutes "abuse," "excessive usage," "material consumption," "bad faith," or "abnormal usage patterns" for the purposes of this section. Webfire may, at its sole discretion, issue a partial refund or service credit in lieu of a full refund where the service has been materially consumed or where full reimbursement would be commercially unreasonable. All determinations made by Webfire under this section are final and binding.
6.5 Refund Processing
Approved refunds will be issued to the original payment method used for the transaction, where technically possible. Processing times may vary depending on the payment provider and are outside Webfire's control. Any transaction fees, currency conversion fees, payment gateway charges, or other third-party processing costs incurred by Webfire in connection with the original transaction or the refund may be deducted from the refund amount to the extent permitted by applicable law.
6.6 Procedure
To request a refund under this guarantee, customers must contact Webfire in writing at support@webfire.ca within the 30-day eligibility period. Refund requests must include the customer's full name, account identifier, and the reason for cancellation. Webfire reserves the right to request additional information to verify eligibility before processing any refund.
7. Backups
We perform daily backups of shared hosting accounts as described in our plan features. While we take reasonable care to ensure backups are reliable, you are ultimately responsible for maintaining your own copies of critical data. Backups are provided as a convenience and are not guaranteed.
8. Uptime
We strive to maintain high availability for all services. While we do not offer a formal SLA with financial credits, we are committed to resolving outages quickly and communicating transparently about service disruptions.
9. Cancellation
You may cancel your account at any time by contacting us. There are no cancellation fees or long-term contracts. Service will continue until the end of your current billing period.
10. Limitation of Liability
Webfire's liability for any claim related to our services is limited to the amount you have paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data loss.
11. Governing Law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein.
12. Changes to Terms
We may update these terms from time to time. We will notify active customers of material changes by email at least 30 days in advance.
